Just curious, why wouldnt you take it back where you bought it & demand a replacement.

Coz you can't do that,
If the item is totally dead, you have grounds to do that, but the retailer would probably still have to get the ok from Evakool, and if it's an intermittent fault the retailer will probably have to send it to Evakool for testing anyway.
Most warranties are worded in a way that the goods can be either replaced, ( does not have to be new) repaired or the purchase price refunded at the dealer/manufacture discretion.
