Buying online - be careful where you buy from

The wife bought an item from an online store. When the item arrived it was the wrong item. Wife calls the store and explains situation. Wife is told we’re the shop you need to use the ‘customer service ticket system’ on the web site for online sales. Wife explains her disappoint and suggests they could do better with customer service. Wife fills out form on ‘customer service ticket system’. Wife gets no response. Wife then gets email referring her to their ‘contract of sale’ which states any form of negative feedback left online will result in said company’s ‘reputation management co.’ coming after her for a minimum of $10,000.

I find it amusing how quickly this escalated into a sh!t fight. I also find it amusing this company believes they’re above the consumer protection laws and their ‘contract of sale’ protects them.

I know exactly what you mean.  I purchased a "Vacuum Sealing Machine and some bage" from an on line store.  I received some telephones, and an email asking me to return the phones which were for another customer.  I have sent the phones back, some time ago, and contacted the on line store, and they apologise saying they have no record of my original purchase.
I have sent the original reciept by fax, and no response.
That on line store is called "Shopping Square", I am happy to name and shame them.

to me, it doesn't sound like the item that was paid for has arrived yet.

how was it paid for? lodge a dispute with your credit card company or, if paypal, lodge a dispute there.

thinking creatively, you haven't purchased that item, maybe it was just for free.  >:D

I'd have already left neg feedback pointing to a URL where I'd post a screenshot of their threat and a whole copy of the email trail...

so it arrived and is not the item purchased

Did your wife tick the wrong box ?
OR
Did the supplier supply the wrong item ??

You will need written proof of the transaction to make your point, and you should follow it up with some of your own legal people if you can prove you are correct and they are wrong in their decision, even so you would think they would do an exchange, requesting you pay half the freight IF no fault can be found as a measure of 'good will'  ;D

If you are stating the truth (which I don't doubt) just photograph the incorrect item for proof of your claim.
They can't sue you for something you havent done.
If you simply state the truth they haven't got a leg to stand on.

Lots of these company's try bully tactics. Most back down when threatened back.
A bit like most bully's really.........

To clarify, wife ordered item A, item B was delivered.

This is their latest response, names removed for obvious reasons, what great customer service.

We did apologise - your statements are factually incorrect.

We have not made any threats - let's be clear on that.

You are 100% correct, you do have rights.

We also have rights.

You have a contract to purchase.

You agreed to those terms and conditions of the contract to purchase.

In the event that you carry out YOUR threats (we have the recorded phone calls to prove it), we have every right to execute OUR rights under the terms and conditons of that contract and common law.

We have sent by way of email a label for you to return the item at our expense so that we can send the replacement at no cost to you.

I have just RESENT another - if you have not received it, please check your email's spam box as it may have gone in there in error.

We have not taken any rights away from you or broken any laws and we have apologise for the error made at our warehouse.

We are not in breach of any consumer protection laws.

If you feel we are, please feel free to make a complaint.

Are you suggesting you have not recieved the "label" so you can return the original item "B" sent to you - at no cost to you ??

As I see it they are trying to get the correct item "A" sent to you at their cost so it will be costing you nothing
OR am I missing something ??

There getting pretty good these guys.

I was reading the water crossing thread and opened up the tab the cucinado posted about the emergency hammer............I bought something from these guys cucinados link is below:

Their name was different but everything else was the same on the page and I ordered a $5 product and it hasn't arrived after two promises of sending it out and an offer for a refund..........

So i reckon some of these companies offering dirt cheap products work on the basis of taking your 3 or 5 bucks and not sending a product and then apologising and then not doing anything about...............
at the moment ebay sucks except for the true regulars like autoelec etc.

that may be a der moment from me but I have only just had it happen to me....

The $80 item in question wasn't purchased from eBay it was from a well known online shop.

Touch wood, I haven't been screwed over on eBay, there's always tomorrow...

Yup. I did some 'research' online, it's amazing what info people think is private when they register their domain name. I then did some more searching and these names appear on several scam sites for pretty much the same thing. Hence the point of my original post, before you buy online do some research on who you're buying from. If in doubt use PayPal and a PO box.

If you want a really good laugh sh!t in a big envelope and then seal it in a parcel express bag and send it confidentailly to the owner of the company and write off the $80 because I reckon if you send the product back you will be arguing for ages about it........

I am a little concerned by this statement, especially the bit in bold. Were you notified prior to your discussion that the call would be recorded. If you weren't it is my understanding that the party being recorded must be advised so if it is to be used in a legal situation.
It would also be interesting to read the terms and conditions of "their" contract because they "may" not be worth the paper they are written on.
