I reckon prevention is better than cure.
Good honest/fair customer service - no defamation issues...

End of the day you need to remember a few things -
1. you are not anonymous online
2. there is no legal right to free speech in Australia
3. if you don't have the money or ability (ie facts) to back up your comments in a court of law, it is best to not make the comments
4. if you think what I have said above is bogus, go start your own forum and do what you like

Exactly.
It's not defamation if it's true. HOWEVER, it can take a LOT of money to prove that! Especially when it's a single person vs a company with a barrage of lawyers and a point to make ;D.
Good reminder.
Thanks!
Matto :)

- if you state clearly that what you are saying or typing is your opinion, then it is very hard to be sued for defamation
- if you state that something is a fact then you can be sued.
this is just my opinion though...
-
If anyone takes my opinion seriously, is it then reasonably practicable to sue them? ;D
-
Yes I can see alot of this occurring.
There are ways of expressing your opinion about a company or bad dealings with some one but make sure you have your facts first.
I know this is off track but working in real estate we can be fined up to $54,000 if we give any indication of a price to a buyer for a property going to Auction.

Thin end of the wedge etc.
Damn, I am going to have to wind up http://www.bigjulesdoesnthavebigjewels.com.au

I will seek some insurance for damages caused by me, err, typing my opinion. 8)
Any brokers on here, there's a market!
-
then it is very hard to be convicted of defamation
There we go - fixed that up for you. You don't have to be guilty to have someone sue you, and the process (and money and time) is the same regardless of whether you are or not.

I've been doing it for years! Puts bread on the table.
Thanks!

Yeah, just ask Andrew Bolt about that

Yeah, just ask Andrew Bolt about that
Fun factiod - there's no "right to free speech" in America either, at least not in the manner that most everyone assumes (which is generally "Absolute Freedom Of Speech").
When it comes to defamation, Derryn Hinch is my go-to guy. Let's face it, he's probably got the most experience. ;D
Thanks!

Well said Symon. The internet is not as anonymous as many would think and i would not like to see any of our members taken to task legally for any misguided comments even if well intentioned.
Cheers

Yeah, just ask Andrew Bolt about that
interesting case that, he actually got in trouble for stating as fact the lineage and upbringing of some of those people. He got some of them completely wrong. That's what he was done for. The other opinion stuff (let's not go there) which got all the attention was left alone in the ruling.

I once had an opinion, I kept it to myself lest Juliar discover how to tax it!

Oh dear I'm sorry what I should have said was
Every business is awesome and they all deserve our hard earned
They never do bad jobs over and over again
What we should do close down all forums because everything is perfect and if we need things done we shouldn't DIY cause we are doing businesses out of work
nor should we be camping in the bush we should all camp in designated caravan park spots
Wow hasn't this place changed
As a consumer I read reviews from real people on products that they have purchased some are good and some are bad reviews. What we are now saying here we shouldn't write bad reviews WTF ???
People need to take other peoples opinions as opinions and use them in ways that would suit them.
How many times have people asked the question "I am buy blahhhh what should I look out for or what options should I look at and not look at ?"
The answer to the above question should now be the product is great and you should tick all the option boxes as the organisation that sell them only sells top quality products.
