I lost 2 young cousins to a POS drink driver that mounted a gutter, ripped a small tree out the ground and entered a childs playground and hit them (obviously speeding). He got a lousy 14 months jail for the 2 lives and I don't think he even served that. Mind you he had a previous record that Derryn Hinch had to scroll the screen 3 times on his shame files episode to show his long list of previous DUI and other driving offences he had been charged with over the years. Ontop of being suspended from driving he was also driving an unregistered and uninsured car at the time too. At court he played the whole "Im illiterate, my fiances pregnant, I go to church etc" while our family have had to pick up the pieces for the rest of our lives...Years later again drunk and breaking the law (heard he was pulled over while intoxicated again but can't confirm it) he tried to stab a police officer but the officers notebook in his top pocket saved him. He got ALOT more that time when sentenced. I'd love to know where to find him today!!!

A bloke I work with is going to court tomorrow for a neg driving charge. He hit a postie when he was turning into a driveway. Postie got a broken leg. The driver stopped immediately and rendered assistance etc and was co-operative. Zero drugs and alcohol. His first court appearence he watched as the local drop kicks in a t shirt and jeans got done for the fifth time no license, unreg uninsured and another for drug possesion for the 155th time say "boo hoo I am trying to get back on my feet, my girl is pregnant blah blah" get a caution and court costs. The bloke from work in a suit early 50's and a fairly good driving record (some old speeding fines) gets told by the beak "I think you better ask for an ajournment and come back with representation as this can turn out to be a custodial sentance". It is not as if he was speeding and left the scene. Where is the equality.

There is no equity, and the drop kicks have lawyers telling them what to say and how to say it. Probably a ploy that they show up without representation as well.

As is the case with most of these things your mate has probably subconsciously spun it to suit what he thinks happens. I have spent months of my life in court and  NO ONE gets a caution for their fifth unlcensed. unregistered uninsured offence.

Similarly the bloke in the 50s would have had a lot more that a 'fairly good driving record' and the matter must have been serious enough to warrant prison time.

I get what he is alluding to though it works both ways.

I was in court and watched the magistrate get up an army officer who wanted a caution for his second drink driving charge.  Magistrate asked him was he any better or more deserving than the tradies that went before him and if so explain how.   Got the same as the others.   :D

Tell your mate when he goes back to court, to wear ripped shirt, and jeans, thongs, stink of durry smoke, poke himself in both eyes so they are red and sore and he will look stoned, and pour some JD over himself to get a fair hearing.

I must admit, the few times I've been to court with mates, I've found it extremely entertaining, like the old stoner that got dragged into sutho court, hadnt had a wasn in 20yrs, clothes were rags, matted hair etc... he lived in the Royal Nat Park in a humpy who was gettin done for some dope.. he started telling the judge he was defending himself, and the judge is a fool, cause if god created it, it must be good for you..
The judge looked at the crim, and then at legal aid bloke, and smiled...
Like your mate judge told him to get some legal representation and he maybe entitled to legal aid... Then there were the 20 DUI's, and the stories that came with them... awesome fun!

I had a mate who worked in a rural court as the registrar and sat in front of the magistrate.

When there were boring stupid hearings on the magistrate would read his favourite book behind the bench while my mate listened in.  Then, when the mag had to do something my mate would hand him a paper and the mag would mutter something and it would move on.   At the end my mate passed him up a piece of paper with the verdict.

Rather than wingeing about the ****wits on this planet I reckon we should do something positive for this family.

I have a 3 room tent which is about 5 years old but still water proof and usable that I would be happy to donate so that when they are back on their feet hopefully they can get out and enjoy camping again.

Maybe we can get Swagmail going and donate some stuff for these guys because no doubt all their stuff was wrecked.............

I look at the shows on TV where people band together to help someone in need and I suppose I wish there was something us members of the forum could do to help this family in recovering and getting back out there to enjoy the dream, but I am a a loss to think where to start or the best thing to do.  I suppose collectively there could be a difference made if it was directed right.

I wrote this earlier but it seems to have been missed, I was trying to think of ways the forum members might be able to help the family, like you mentioned, its OK to discuss how to deal with the person who caused the problem, but its not helping those victims.  If there is a way to support them lets try.

Maybe get them a timeshare on the 55th floor of a Gold Coast apartment block? Do you think they'd want to sleep in a tent again?!
