Penalty for Driving whilst Disqualified in New South Wales:

- For a first time offender the maximum penalty that may be imposed is a fine of $3,300 and/or a prison sentence of 18 months. There is also a mandatory licence disqualification period of 12 months given to all first time offenders.

- For a second or subsequent offence the maximum penalty is a fine of $5,500 and/or a prison sentence of 2 years. A mandatory further licence disqualification of 2 years is also imposed.

That means nothing. Since when do the maximum sentence get handed out and followed through on. Maximum, now that is a joke.

That is why the disqualification period far exceeds anything else.  Judicial system finds it easier to place the maximum disqualification period as 'punishment' then a fine or gaol time.  Does it really achieve anything.  No, not really.  It may make Magistrates and Judges feel like they have achieved something but that would be about all.  There are a lot of similar cases where the system has loaded people with extensive periods of disqualification with little to no affect on stopping that person driving.  Highway Patrol types get all excited about the extended lengthy periods.  There is alternative penalties the Judaical System can take but alas they are stuck with what they have and so the periods continue with nothing achieved.

Adding on to an already unobtainable licence is more likely to be counterproductive. He will never get a licence so what incentive is there not to drive?  So he does anyway, so it is even easier to disregard all the other rules. If it was possible he could get a licence in a few years he might not. (Yes highly unlikely anyway.) They need to look at the other options.

So, how do we fix the drink/drug driver problem?  ???

Can't throw 'em in jail, they're already overcrowded.
The do-gooders would never let it happen anyway.

Shooting them is illegal.

Christ, I just finished watching the latest dash cam Australia clip for Dec 17 and most these days, can't drive sober.... IE haven't got a clue.

The poor excuse of a test for getting licensed won't change anytime soon.
The wife and I were watching TV the other night and they're referring to recreational drugs.
Aren't they just illegal drugs or have I missed something?

Stuffed if I know the answer and i'm afraid we've gone so far down the toilet, we may never make it back to the top again. And that's just plain sad.

I'm syre most of us would have seen this little treasure on last night's news: http://www.abc.net.au/news/2017-12-30/p-plater-allegedly-caught-driving-more-than-100km-over-limit/9294814

105kph over the limit :o, while still on red P's >:(

"the Holden Commodore driver was issued with a high-range speeding fine, which includes a $1,177 fine, the loss of eight demerit points and an automatic six-month licence suspension."

That should have been $11770, vehicle confiscated & 10 year loss of licence! >:D
