Title: Interesting getting a road worthy for a landcruiser !!

I am buying a bargain landcruiser and the seller advised that the local Toyota dealer in Cairns would not sign the road worthy without the rear seats in as it is registered as an 8 seater as most cruisers are. So he had to put them in to get it signed off.

Interesting as alot of people have draw systems installed and rear cargo barriers which makes it impossible to put the rear seats in.

Has any one had this problem !!

Interesting, I did read something about this previously, in fact I think 4wdvic put out a press release on it that it is bogus.

Hi McGirr, I brought my 105 a few years ago and it didn't have the head rests for the rear seats, that was not road worthy. I ended up have Queensland Transport to defect the car to get the car yard to do anything about it. I had spoken many times the the car yard and all he said is "do what you want" he didn't care at all even tho the road worthy was done on the 25Th April. Yes ANZAC day the car was registered on the 29Th April and I picked it up on the 24Th April. I know doesn't add up that's what I thought. Any way after main roads and the freedom of information act and about 8 months the car yard ended up paying for half the head rest. I know my own fault for not checking it all before I took it of the lot but live and learn. So yes if it is registered for 8 seats it need 8 seats even head rests. Oh and again great colour  :cheers: Sorry forgot to say in house road worthy.

Yep if it's registered as an 8 seater than it needs a RWC as an 8 seater or the person signing off on it isn't doing the job properly.

You can get a mod plate for a seating capacity change, then there is no problem with RWC.

I had this exact problem when trqansfering my rego to the ACT in 2008 (over the pits for the initial inspection). I had a full length cargo barrier in and the rear seats removed. I had done my research  having been warned that this might be raised. The compliance plate indicates the "Maximum" number of seats that can be fitted to the vehicle but most interpret this as 8 seats means 8 seats.
They sent me packing because I still had the seat belts installed therefore it was an 8 seater and they had to see the seats - fair enough, I should have removed them. So I went back to work and borrowed a pair of seats from a mates 100 series and went straight back - easier than removing the belts at teh time. Note that you have to pay an additional fee or every additional inspection. A different assessor this time tells me that my car was unroadworthy because I had seats fitted behind a cargo barrier!!

This is where I, how shall we say... lifted the tension in the building by explaining in no uncertain terms what I had been told only one hour earlier. They guy looks at me and says that "no one here would have told you that". I look over his shoulder to see the previous inspector walk into the room so I just glared and pointed saying "That bloke did!". The other inspector sensed troubled, and sheepishly backed out of the room. My anger attracted a manager who thankfully saw my predicament (and no doubt the retreating inspector) and then tells me to just take it to the car park, remove the seats and the seat belts and I'll be on my way - which is what happened. Thankfully there are other options than taking it over the pits every year. I still get questions from some mechanics doing my rego inspection even with a copy of the compliance details, but with drawers now fitted, I dont seem to have the same problem.

Hi all - had the same issue about a month ago ( have a 60 series). Had the seats at home, so no real probs. my issue though was that I have a 2nd diesel tank - installed when new in 1988 ... and a couple of owners ago!! Needed a compliance plate, so an extra $150 :(

My Dad had this same issue with his 15 (?) seater ... yeah all those sideways seats in the back.  What he did was to have the rego re-issued as a few less seats (these held up the bed base he made) and he was happy and saved some $.  Why would you ever want to move around a shop load of backpackers?

I went through this awhile ago. When we got the Cruiser I removed the third row seats and fitted draws. Not long after we moved from Tassie to Kununurra in W.A. After a few months I got the rego transfered to W.A, no third row seats but registered no worries as a 8 seater.
Forward a year and we moved back to Tassie and I had to change rego back. This time they said, no seats in the back so its a 5 seater.
I have been told that as long as the seat belts were still there and all seat mounts were still in vehicle(ie removable seats), it didnt have to have the seats installed. Tried telling the inspector this but wouldnt listen.
I think it depends on the inspector.

the rule book is really clear about seating.
any change to seating capacity must be blue plated.whether up or down.
the only grey area is in some inspectors heads.

I took the rear seats out of mine 18 months ago after which I had it registered in my name then reregistered 12 months later with seatbelts still in but no rear seats and no issues at all.

I had a road worthy done to transfer rego from WA to TAS on my V6 Prado had the rear seats out no questions asked passed no worries went and paid transfer fees and swaped over the plates placed the sticker on the car looked at the rego papers the inspector also passed it as a 4 cylinder ? So the question is do they really know what they're doing

On a different tact, bloke in my club went to get roady on a GQ he was selling, with lift and big tyres..

they all passed, but the bloke wouldnt pass it with adjustable panhard rods... strange

there is another part of the TMR website that looks at seats and what you can do while you own the vehicle compared to what is needed when selling
it's worth looking up seeing as insurers like to grab onto any loophole they can to get out of a claim these days

Well here is another one for you guys, Out here in Moranbah we don't even have to get a roadworthy to transfer rego, There is no one in town that does roadies and we live to far from the nearest roady site so we only have to have a stat dec. that states to the best of your knowledge the car is in a roadworthy condition. easy as that.

An older bloke, once told me that the Motor reg's book is like the Bible.
Everybody has a different interpretation of it.
